Maybe it's because I'm a scuba diving instructor, but I can't imagine diving without some kind of surface indicator. 

Even getting hit by a Hobie kayak could be fatal, and you also don't want to get snagged with a big 2oz jighead either.

At least one person would die every year out in the Philippines where I used to instruct, every time from surfacing without a marker and getting runover by a boat.

Hawaii has very little regulation when it comes to sport fishing, but diving with a flag happens to be one of them.
Glad no ignorant folks got hurt, and that it hopefully will result in more folks getting educated on how to be safe in the ocean.
